Utility Island Terms of Use

The rules, in plain English.

These terms cover your use of Utility Island for macOS. They are the agreement between you and me — the person who built it. Downloading or using the app means you accept them, so they are written to be read rather than skipped.

01The agreement

Utility Island is developed and published by Andrii Kolisnyk, an independent developer based in Ukraine. By downloading, installing or using it you agree to these terms. If you do not agree to them, do not use the app.

How your information is handled is covered separately, in the Utility Island Privacy Policy, which forms part of this agreement.

02Your licence

Andrii Kolisnyk grants you a personal, non-transferable, non-exclusive licence to use Utility Island on any Apple-branded Mac that you own or control, as permitted by the Usage Rules in Apple's App Store Terms of Service. The licence is granted — Utility Island is licensed to you, not sold.

  • You may not redistribute, rent, lease, lend, sell or sublicense the app.
  • You may not reverse engineer, decompile or disassemble it, except to the extent that applicable law expressly permits despite this restriction.
  • You may not remove or obscure any copyright, trade mark or other proprietary notice.

03Eligibility

You must be at least 13 years old to use Utility Island. If you are under 18, you must have permission from a parent or guardian.

04Payments and subscriptions

Utility Island offers paid features through the Mac App Store. Prices are displayed in the app and may vary by region.

  • Payments are processed by Apple under Apple’s own terms and conditions.
  • If the purchase is a subscription, it renews automatically unless cancelled at least 24 hours before the end of the current period, and your account is charged within 24 hours prior to the end of that period.
  • Manage or cancel at any time in System Settings → Apple Account → Media & Purchases → Subscriptions.
  • No refunds are handled directly by me — contact Apple for refund requests.
  • Prices are subject to change, with notice.

Statutory rights come first: if you are a consumer in the EEA or the UK, your right to withdraw from a purchase within the legal cooling-off period applies regardless of anything in this section.

05Using the app responsibly

You agree not to use Utility Island to store, transmit or process material you have no right to, not to use it in a way that breaks any applicable law, and not to attempt to interfere with or gain unauthorised access to any system through it.

06Your files and your clipboard

Everything you put on the shelf or copy through the clipboard is yours. I claim no ownership and no licence over any of it, which is easy to promise given that none of it ever reaches me.

The shelf is a temporary holding place, not a backup. Files parked there can be lost if the app is deleted, if its container is cleared, or if the file is moved at source. Keep your own copy of anything you cannot afford to lose. I have no ability to recover it.

Please also read the clipboard warning in the privacy policy before you use the history feature with sensitive material.

07Intellectual property

Utility Island, its name, its icon, its design and its code remain the property of Andrii Kolisnyk and are protected by copyright and trade mark law. Nothing here transfers any of that to you beyond the licence described above.

08Changes to the app

Utility Island is actively developed, and it depends on macOS behaviour that Apple controls — notch geometry, window layering, drag-and-drop and the permission model. A future version of macOS may change or remove behaviour the app relies on. Features may be added, changed or removed as a result, and support for older versions of macOS ends as Apple’s own support does.

09Limitation of liability

Utility Island is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. I do not warrant that it will be uninterrupted or error-free, or that it will remain compatible with every future version of macOS.

To the maximum extent permitted by law, I am not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data or files, arising from your use of or inability to use the app, and I am not responsible for third-party services such as app stores. Where liability cannot be excluded, my total liability shall not exceed the amount you paid for the app in the 12 months preceding the claim.

Some jurisdictions do not allow these exclusions. Where that is the case they apply only so far as permitted, and your statutory consumer rights are unaffected.

10Termination

This licence ends automatically if you breach these terms, and you may end it at any time by deleting Utility Island from your Mac. The sections on intellectual property, liability and governing law survive termination.

11Apple’s role

This agreement is between you and Andrii Kolisnyk only, not with Apple. Apple is not responsible for Utility Island or its contents, and is not a party to these terms.

  • Support. Andrii Kolisnyk is solely responsible for any maintenance and support for Utility Island. Apple has no obligation to provide either.
  • Warranty. Should Utility Island fail to conform to any warranty that applies, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are Andrii Kolisnyk’s responsibility.
  • Claims. Andrii Kolisnyk, not Apple, is responsible for addressing any claim you or a third party makes about Utility Island — including product liability claims, any claim that Utility Island fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
  • Intellectual property. If a third party claims that Utility Island infringes its intellectual property rights, Andrii Kolisnyk, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
  • Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms and, on your acceptance, have the right to enforce them against you.

You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

12Modifications to these Terms

These terms may change as the app changes. The date at the top of this page is always the date of the current version, and material changes will be announced in the App Store release notes. Continuing to use the app after a change means you accept the revised terms; if you do not, stop using it and delete it.

13Governing law and disputes

These terms are governed by and interpreted under the laws of Ukraine, and any disputes will be resolved in the courts of Ukraine. For users in the EU: nothing in these terms affects your rights as a consumer under EU law.

If any provision is found to be unenforceable, the remaining provisions continue in full force and effect.
